Mr. Miller is board-certified by the Florida Bar in Labor and Employment Law. He has represented management exclusively in that practice for his entire legal career. Mr. Miller has also represented businesses and individuals in commercial litigation. He is a specialist in both traditional labor law and in employment law. In his labor work, he has worked with management to craft and implement effective union-avoidance programs and has helped conduct election campaigns that were successful in defeating union organizing efforts. In workplaces that are already organized, he helps employers with day-to-day labor relations and contract negotiations. He has extensive experience handling grievances and arbitrations and in defending employers in litigation before regulatory agencies. His labor litigation experience includes successful advocacy in the courts of appeals. Mr. Miller's experience spans the spectrum of employment law. The focus of his practice is advising human resources and other managers how to avoid employment and regulatory compliance issues or to deal with them successfully so that they do not become larger problems. This can range from day-to-day counseling to personnel policy and practice audits and updates, including pay practices audits to ensure compliance with the Fair Labor Standards Act (the federal minimum wage and overtime law). He has defended employers in matters from charges of discrimination or whistleblower retaliation to state and federal court employment litigation on a wide range of legal issues. Mr. Miller also represents public entities who sponsor retirement systems in their dealings with Boards of Trustees, participants, and state regulatory agencies. Mr. Miller earned his Bachelors degree from Newberry College, magna cum laude, in 1978 his Masters degree from the University of Tennessee in 1982, and his Juris Doctor from Stetson University College of Law, magna cum laude, in 1998.
