Michael Elkins wins major federal court case dealing with complex U.S. constitutional issue

Congratulations to Michael Elkins from our Miami office for winning a major federal court case dealing with a complex U.S. constitutional issue.

The client is a private corporation that had a contract with the State of Florida to provide certain services. The client was sued in federal court by two former employees claiming a violation of the First Amendment and retaliation for alleged whistleblower activities.

Michael successfully argued that the client, although being a private corporation, was entitled to immunity from suit in federal court under the Eleventh Amendment to the United States Constitution. At oral argument, on a motion to dismiss, a U.S. District Court judge granted his motion to dismiss, holding that the client was entitled to immunity and dismissing the lawsuit. This is the second time Bryant Miller Olive has achieved this result for this client in federal court.
