Mr. Constantine has broad experience representing governmental and private industry clients involved in development, financing, construction and operation of sustainable energy, renewable, utility and infrastructure projects, from initial structuring of projects through negotiation of professional service, major equipment, EPC, design/build, transmission, supply and off-take and operation and maintenance agreements. Mr. Constantine also represents developers and owners in the financing, acquisition and sale of electric, water, wastewater, pipeline and transmission projects. His current engagements include representation of the following clients:

  • an independent power producer in the development and financing of four biomass fueled electric generating facilities in the State of Florida the output of which has been committed to investor owned utilities under long term power purchase agreements
  • a major public water/wastewater utility in the negotiation of a long-term agreement for the supply of treated effluent to an electric generating facility
  • a public university in the development of an innovative public-private-partnership for the design, construction and maintenance of student housing, health and wellness and dining facilities
  • a state college in the ground leasing of a portion of its downtown campus for a public-private-partnership development
  • an information technology company in connection with its proposal for performance of intelligent transportation system design, installation and maintenance services in connection with a toll concession for the capacity expansion of a segment of a heavily traveled interstate highway
  • a municipal utility in the acquisition of water distribution and treatment systems and facilities and consumption right permits
  • a developer in the structuring of arrangements for sale and transport of LNG and design, construction and maintenance of re-gasification facilities at client manufacturing facilities

Mr. Constantine’s alternative and renewable energy projects include representation of a wood pellet manufacturer in the development and financing of its production facility and negotiation of wood pellet supply agreements with foreign utility and generation companies; representation of a consortium of municipal electric utilities as project counsel in the structuring and documentation of their participation in the development and ownership of a solid fuel generating facility; representation of a municipal electric utility in the negotiation of a bulk power supply agreement; and representation of a private developer in the negotiation and documentation of development, lease and supply agreements for the development of a CNG fueling facility to primarily serve a county school district’s bus fleet. Mr. Constantine’s acquisition experience includes representation of the South Florida Water Management District in its acquisition of approximately 28,000 acres for restoration and a related agreement for the relocation of railroad tracks located on the property and representation of both private and public entities in the purchase and sale of water and waste water utility systems.

Prior to joining Bryant Miller Olive, Mr. Constantine was a partner in a major international law firm. He was a member of the project finance and energy practice groups and represented clients in the development, financing and purchase and sale of electric generation, renewable energy generation and transmission, gas pipeline, water, waste water and manufacturing projects throughout the U.S. and in South America, Europe and Africa.
